GENERAL TERMS
Once you avail of any Anytime Fitness Membership, it confirms your acceptance to these Terms of Service and your agreement to be bound by it. If you do not accept these Terms of Service, do not avail a membership. In the event of a violation of these Terms of Service, ALL OUT FITNESS GROUP reserves the right to seek all remedies available by law. We may terminate your membership at any time, for any reason or no reason without prior notice to you.
PRIVACY POLICY
The Club will manage the member’s personal information in accordance with Anytime Fitness Philippines’ Privacy Policy. A copy of the Privacy Policy can be found on Anytime Fitness Philippines’ website at https://www.anytimefitness.ph/privacy-policy/. This webpage contains information relating to the collection, use, and disclosure of the member’s personal information.
REFUND POLICY
All fees paid to the establishment are non-refundable under any circumstances. These fees include but not limited to membership fees, personal training fees/packages, merchandise, etc.
USE OF KEY FOB / TRANSFER OF MEMBERSHIP
The member must always bring his/her key fob whenever he/she goes to any branch of Anytime Fitness. He/she must present his/her key fob upon entering the Club and it only admits him/her. The Club has a “No Key Fob, No Entry” policy. Also, the member cannot transfer his/her membership to any other person.
MISUSE OF KEY FOB / TAILGATING
The member must not allow anyone else to use his/her key fob and must alert the Club immediately if it got lost or stolen. If this policy is violated, he/she may be charged a penalty fee of ₱500.00 and/or have his/her membership suspended or cancelled subject to cancellation fees. For lost or broken key fobs, there will be a replacement fee equivalent to the cost of a new key fob, which is ₱2,500.00.
GUESTS
The member may bring first-time guests by setting an appointment with the Club staff from 10:00am to 5:00pm daily. Guests are required to present one (1) valid ID and fill out the Guest Registration Form upon arrival. There will be a guest fee of ₱500.00 for every succeeding visit of the guest.
RECIPROCITY / TRANSFER TO ANOTHER CLUB
After 30 calendar days, the member will have access to other Anytime Fitness Clubs. Over a period of 60 calendar days, his/her membership may be transferred to a Club that he/she frequently visits other than his/her Home Club. Once transferred, he/she will be required to pay the membership dues of that facility which may be more than the dues payable under this Agreement and follow their in-club policies and procedures.
DUE DATE / MODE OF PAYMENT
The member agrees that the monthly membership due date is every 1st day of the month at 12:00am. It will be deducted automatically from his/her nominated credit card in the Club’s system. Alternative modes of payment such as cash, debit card, other credit card, etc. must be settled at least seven (7) days before the 1st day every month. It is the sole responsibility/obligation of the member to make sure that his/her membership dues are updated. The Club is not responsible/obligated to remind the member to settle his/her monthly membership dues.
*Note: This is not applicable for Paid-in-Full membership
FAILED PAYMENT FEE
It is the sole responsibility/obligation of the member to ensure that his/her nominated credit card in the system is valid with sufficient credit limit on every due date. There will be a penalty fee of Php 424.00 for every failed transaction. Debit/prepaid card auto-debit service is not guaranteed and may incur failed payment fees. This will happen every seven (7) days and the member’s gym access will be suspended. The Club is not responsible/obligated to remind the member to update his/her credit card details due to expiration, changes made by the bank, unauthorized transaction, loss, or breach.

DELINQUENT ACCOUNTS
The member irrevocably agrees and understands that the failure to meet the requirements in CLAUSES 7 and 8 may result to legal actions including but not limited to forwarding his/her personal information to debt collection service providers, law firms, financiers, government authorities, or other organizations. Furthermore, the member will have a bad credit standing with Anytime Fitness® LLC. The member agrees that the Club shall be entitled to recover all costs and expenses resulting from the engagement.

LOCK-IN PERIOD / NON-EXPIRING MEMBERSHIP
The member agrees that his/her membership is subscription-based and has a lock-in period. It does not expire. The lock-in will only be lifted once the member has fully paid the coverage of the lock-in period (6 paying months or 12 paying months). If the member wishes to end his/her subscription on the 6th or 12th month, cancellation must be requested and processed at least 30 days prior the end of lock-in period. Otherwise, membership will be ongoing and the member will still be charged for monthly membership fees.

NON-USAGE
If the member fails to use the Club facilities regardless of any reason, that shall not release him/her from the obligation to make all payments required by the terms of this Agreement.
FREEZING PROCEDURE
Should the member be unable to use the facilities, he/she may freeze his/her membership depending on the lock-in period. However, the lock-in period will extend every time the member freezes his/her account depending on the duration of the freezing period. Freezing initiated by the Club due to temporary closure as mandated by the government will also extend the lock-in period of membership accounts. Freezing is not allowed if the status of membership is “Defaulted”.
Once freezing privilege/s is/are already used up, a freezing fee of 20% of the monthly due will be charged to the client per freezing month to process the request.
For members on monthly mode, freezing requests must be sent to the official email address of the Club at least seven (7) calendar days before the 1st day of the month. This may also be done face-to-face at the gym office. Requests made thru calls, SMS, or social media will not be honored. Requests made after the 1st day of the month will not be honored. Freezing months are not counted to the coverage of the member’s contract duration (6 paying months or 12 paying months).
Freezing in the middle of the month is not allowed. The denomination of freezing is on a per month basis. If the member fails to file his/her freezing request before the 1st day of the current month, he/she will be charged the monthly fee. Offsetting payments for future months are not allowed.
For members on PIF mode, freezing requests must be sent to the official email address of the Club at least seven (7) calendar days before the start date of freezing. This may also be done face-to-face at the gym office. Requests made thru calls, SMS, or social media will not be honored. Requests made on or after the start date of freezing will not be honored.
CANCELLATION PROCEDURE
Should the member decide to pre-terminate or cancel his/her membership subscription; a cancellation request must be sent to the official email address of the Club at least 30 calendar days from the intended date of cancellation. This may also be done face-to-face at the gym office. Requests made thru calls, SMS, or social media will not be honored. Cancellation is not allowed if the status of membership is “Defaulted”, “Frozen”, or “Suspended” unless initiated by the Club. The member understands that the Management may require him/her to pay a pre-termination fee of Php 5,000.00 or 2 months’ worth of monthly dues whichever is higher and/or the pro-rated amount of 30 calendar days if the membership is still within the lock-in period, cancellation requests will not be processed until all required cancellation fees are settled.
If the account is “Defaulted”, the member must settle his/her outstanding balance/s first before his/her cancellation request can be processed. Outstanding balance/s and/or cancellation fees are non-waivable under any circumstances.
APPROPRIATE GYM ATTIRE AND FOOTWEAR
The member must wear appropriate gym attire and footwear at all times to prevent the member from being at risk of any potential injuries. Appropriate gym attire and footwear should be suitable for the activity and support/keep the member comfortable. Breathable and/or stretchable fabrics are ideal. Wearing inappropriate attire includes revealing clothes, loose fitting shoes, flip flops, slippers, stiletto heels, denim pants, skinny jeans, smart button shirts, suits, etc. The Club shall not be liable or obligated to compensate anyone if this clause is violated and resulted to injuries, disabilities, or death happened in the facility.
ETHICS
The member must not engage in any type of unauthorized commercial or business activity while using the facilities. He/she will neither act as a trainer for any other member or guest, nor do any acts which would constitute such business activities. Doing so will lead to a penalty fee of Php 5,000.00 per involved person. The member must not molest, badger, assault or harass other club members, guests or employees. Doing so will subject his/her membership account to immediate cancellation and the member will be obligated to pay the remaining balance/s covering the lock-in period immediately.
EMERGENCY PROCEDURES
The member must be knowledgeable and responsible in operating the emergency buttons. These buttons can only be used in case/s of emergency. Misuse of any of the alarms and/or safety equipment may lead to heavy fines.
FORCE MAJEURE
The Club shall be free from any liability or obligation on circumstances beyond its control such as but not limited to war, strike, riot, crime, epidemic, pandemic, flood, or any event described by the legal term, “Acts of God”. The Club however, should be fair enough to extend payment suspensions and/or other options to members only during times of temporary closure as mandated by the government due to events covered by “Acts of God”. Nevertheless, the Refund Policy Clause still applies.
UPDATE OF RECORDS
It is the sole responsibility/obligation of the member to update his/her Customer Information Record, if needed. Requests to update records must be sent to the official email address of the Club. This may also be done face-to-face at the gym office. Requests made thru calls, SMS, or social media will not be honored.
EMAIL SUBSCRIPTION
Email is the Club’s main platform to send updates to its members. All members are automatically subscribed to the Club’s mailing list so that the Club would be able to send marketing emails and other important advisories to its members. The member may unsubscribe from the mailing list but he/she will not be able to receive marketing emails and other important advisories. Hence, the Club shall not be liable if the member was not able to receive updates thru email and/or was not able to read the email on time. It is the sole responsibility of the member to ensure that his/her given email is working and check his/her inbox and other email folders regularly.
CHANGES TO TERMS
These Terms of Service are effective as of 25 April 2022 and will apply to current and future members (with signed or unsigned Terms of Service) of this Club after being sent to all members through their subscribed email addresses on the Club’s database. The Club recommends that members check their email periodically to keep informed with any changes.
The Club reserves the right to amend these Terms of Service provided that members will be notified via email at least three (3) calendar days before the date of its effectivity. If the member did not initiate any action such as freezing/cancellation of his/her membership and/or continues to use the facilities after any amendments to these Terms of Service, it will constitute the member’s acknowledgement of the amendments and the member’s consent to abide and be bound with the amended Terms of Service.
